Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ("AUP") governs all use of the RogIQ platform ("Platform") operated by Rogue Active Intelligence Inc. ("RogIQ," "we," "us," or "our"). It defines the standards of conduct we require of all Platform users and the behaviors that are prohibited.

This AUP is incorporated into and forms part of RogIQ's Terms of Service. By using the Platform, you agree to comply with this AUP. Violations may result in suspension or permanent termination of your account.


2. Who This Policy Applies To

This AUP applies to:

  • All users who access or use the RogIQ Platform, regardless of account type;
  • Agency Account holders and all sub-accounts they manage;
  • Resellers and their Authorized Clients;
  • Anyone who accesses the Platform using credentials issued to a Platform account.

Agency and Reseller Responsibility. If you hold an Agency Account or are a Reseller, you are responsible for ensuring that all sub-accounts, Company Accounts, and clients under your account comply with this AUP. You are liable for your clients' violations to the same extent as your own.


3. Prohibited Content

You may not create, publish, distribute, or promote through the Platform any content that:

3.1 Is Illegal or Violates Third-Party Rights

  • Violates any applicable local, state, federal, or international law or regulation;
  • Infringes the copyright, trademark, patent, trade secret, or other intellectual property rights of any third party;
  • Violates any person's right to privacy, including unauthorized collection or disclosure of personally identifiable information;
  • Constitutes defamation, libel, or slander;
  • Constitutes or facilitates the illegal interception of communications.

3.2 Is Harmful, Threatening, or Harassing

  • Threatens, intimidates, or incites violence against any individual or group;
  • Harasses, bullies, or stalks any individual;
  • Targets individuals or groups with hateful content based on protected characteristics, including race, ethnicity, religion, national origin, gender, sexual orientation, disability, or veteran status;
  • Promotes, glorifies, or facilitates terrorism, mass violence, or genocide;
  • Constitutes child sexual abuse material (CSAM) or any content that sexually exploits or harms minors.

3.3 Is Deceptive or Manipulative

  • Is designed to mislead consumers about the nature, quality, pricing, or source of products or services;
  • Constitutes false advertising or violates FTC guidelines, including failing to disclose material relationships, endorsements, or paid promotions;
  • Impersonates any person, business, organization, or government entity without authorization;
  • Spreads deliberate misinformation or disinformation;
  • Constitutes phishing or other deceptive practices designed to obtain personal information fraudulently.

3.4 Is Spam or Unsolicited Communication

  • Constitutes spam or unsolicited bulk commercial email in violation of CAN-SPAM, CASL, or other applicable anti-spam laws;
  • Sends unsolicited SMS or phone calls in violation of the TCPA, TSR, or other telemarketing laws;
  • Uses harvested email addresses or contact lists obtained through unauthorized means;
  • Suppresses opt-out requests or uses deceptive headers or subject lines.

3.5 Involves Regulated Industries Without Compliance

  • Promotes or facilitates the sale of illegal drugs, controlled substances, or unprescribed pharmaceuticals;
  • Promotes gambling services in jurisdictions where they are not lawfully permitted;
  • Promotes firearms, ammunition, or weapons in violation of applicable law;
  • Engages in unsolicited or unlicensed financial, investment, legal, or medical advice;
  • Promotes or facilitates multilevel marketing (MLM), pyramid schemes, or Ponzi schemes;
  • Advertises cryptocurrencies or digital assets in violation of applicable securities laws.

3.6 Is Adult or Sexually Explicit Content

  • Contains pornographic, obscene, or sexually explicit content unless you have obtained explicit prior written authorization from RogIQ for verified adult content platforms operating in compliance with all applicable laws.

4. Prohibited Platform Behaviors

You may not engage in the following behaviors on or through the Platform:

4.1 Security and Access Violations

  • Attempting to gain unauthorized access to any portion of the Platform, other users' accounts, or any connected systems or networks;
  • Using the Platform to launch attacks against third-party systems;
  • Circumventing or disabling security features, access controls, or authentication mechanisms;
  • Performing unauthorized penetration testing, vulnerability scanning, or security research on the Platform without RogIQ's prior written authorization.

4.2 Platform Integrity Violations

  • Reverse engineering, decompiling, or disassembling any part of the Platform;
  • Introducing malware, viruses, ransomware, Trojan horses, or other malicious or harmful code;
  • Interfering with the proper functioning of the Platform, including launching denial-of-service attacks;
  • Attempting to access, alter, or destroy data belonging to other users.

4.3 Resource Abuse

  • Using automated tools (bots, scrapers, crawlers) to access, extract, or index Platform content without prior written authorization;
  • Creating multiple accounts to circumvent usage limits or Platform restrictions;
  • Attempting to "back-to-back" free trials or gaming trial periods to avoid subscription payments;
  • Generating excessive API calls or consuming Platform resources in a manner that impairs service for other users.

4.4 AI Feature Misuse

  • Using AI features, including Genius Mode, to generate content that violates any provision of this AUP;
  • Using AI features to create deepfakes, non-consensual intimate imagery, or deceptive media designed to mislead;
  • Attempting to manipulate, jailbreak, or circumvent AI safety measures built into the Platform;
  • Using AI features to generate individualized professional advice (legal, medical, financial) without appropriate human review and disclaimers;
  • Submitting sensitive personal information (health records, financial account numbers, government ID numbers) to AI features unless expressly permitted.

4.5 Marketplace Conduct (if applicable)

  • Publishing misleading, inaccurate, or fraudulent listings in any RogIQ marketplace;
  • Generating or soliciting fake reviews, testimonials, or ratings;
  • Using the marketplace to distribute malware or unauthorized software.

5. Agency Account Responsibilities

If you hold an Agency Account or operate as a Reseller, you are responsible for:

  • Ensuring all users and clients under your account comply with this AUP;
  • Providing tier-1 support and oversight for all sub-accounts;
  • Establishing your own acceptable use policies for your clients that are no less restrictive than this AUP;
  • Immediately investigating and addressing any reports of AUP violations by users under your account;
  • Notifying RogIQ promptly if you become aware of any serious AUP violation under your account.

6. Genius Mode and Autonomous Publishing

Genius Mode enables autonomous or semi-autonomous AI content creation and publishing. If you enable Genius Mode (or allow clients to use it):

  • You must configure appropriate content guardrails before activation;
  • You must regularly review content published through Genius Mode for accuracy, compliance, and brand alignment;
  • You are solely responsible for all content published through Genius Mode, regardless of the level of human review applied;
  • You must have a plan to immediately disable Genius Mode if problematic content is identified;
  • You must comply with platform-specific terms for any social media platforms on which content is published.

7. Social Media and Third-Party Platform Compliance

When using the Platform to publish to social media or third-party platforms:

  • You must comply with all applicable platform terms of service for each platform on which you publish;
  • You are responsible for obtaining all required authorizations and permissions to publish on behalf of your clients;
  • You must comply with all disclosure requirements (e.g., labeling AI-generated content where required);
  • You must comply with all copyright and licensing requirements for media published through the Platform.

8. Reporting Violations

If you become aware of activity on the Platform that violates this AUP, please report it to:

RogIQ will investigate all good-faith reports and take appropriate action.


9. Enforcement

RogIQ may take any of the following actions in response to an AUP violation, at its sole discretion:

  • Issue a warning to the account holder;
  • Temporarily suspend access to the Platform or specific features;
  • Permanently terminate the account;
  • Remove offending content;
  • Disable specific Platform features (including Genius Mode);
  • Report illegal activity to appropriate law enforcement or regulatory authorities;
  • Seek injunctive relief or other legal remedies.

RogIQ reserves the right to take immediate action without prior notice where a violation poses a risk of harm to users, third parties, or the integrity of the Platform.


10. Changes to This Policy

RogIQ may update this AUP at any time. Updates will be posted on the Platform with an updated effective date. Your continued use of the Platform after any update constitutes your acceptance of the revised AUP.
