Rogue Active Intelligence Inc. ("RogIQ," "we," "us," or "our") respects your privacy and is committed to protecting your personal information. This Privacy Policy describes how we collect, use, share, and protect information about users of the RogIQ platform at rogiq.com and related services (collectively, the "Platform").
Scope of This Policy. This Privacy Policy applies to RogIQ's direct customers (businesses and individuals who create a RogIQ account). It does not apply to the personal data of end users that our customers process through the Platform using their own accounts. If you are an end user of a business that uses RogIQ, please consult that business's privacy notice for information about how your data is handled.
If you are a customer using RogIQ as a data processor under the EU General Data Protection Regulation (GDPR) or similar laws, please refer to our Data Processing Agreement (DPA) for information about how we process personal data on your behalf.
Please read this Privacy Policy carefully. Your continued use of the Platform after any updates to this policy constitutes acceptance of those updates.
2. Information RogIQ Collects About You
We collect personal information ("Personal Information") about you in the following ways:
2.1 Directly from you when you provide it to us, including when you:
- Create a Platform Account or sign up for a free trial;
- Make a purchase or subscribe to a plan;
- Contact us for support or submit a support request;
- Subscribe to marketing communications or our newsletter;
- Participate in surveys, promotions, or events;
- Communicate with us via email, phone, or chat.
Types of information collected directly include: name, company name, email address, billing address, phone number, payment information (processed by our payment processor — we do not store full card numbers), and any information you choose to provide.
2.2 From third parties, including:
- Marketing and analytics partners;
- Data enrichment providers;
- Social media platforms (when you connect social accounts);
- Integration partners (when you connect third-party services to the Platform).
2.3 Automatically when you use the Platform, including:
- Device information (browser type, operating system, device identifiers);
- Log data (IP address, pages visited, time spent, referring URLs);
- Usage data (features used, content created, interactions with the Platform);

3. How RogIQ Uses Your Information
We use Personal Information we collect for the following purposes:
3.1 Platform Functionality and Development. We use information to provide, operate, maintain, personalize, and improve the Platform. Some information, including usage patterns and feature interactions, is used to develop new features and enhance existing ones.
3.2 AI Features. Some Platform features leverage artificial intelligence to enhance performance and personalization. Data you provide or that is generated through your use of the Platform may be used to improve AI model performance, train AI features, and personalize AI-generated outputs. We do not use your customers' personal data to train AI models that serve other customers, except in anonymized and aggregated forms.
3.3 Customer Support. We use your information to provide customer support, diagnose technical issues, and respond to your requests and inquiries.
3.4 Business Operations. We use information for billing, accounting, fraud prevention, security monitoring, and other internal business operations.
3.5 Communications. We use contact information to send you:

- Marketing communications, where you have opted in or where permitted by applicable law.

3.6 Security and Fraud Prevention. We use information to protect the Platform, detect and prevent fraud, abuse, and security incidents, and to comply with our legal obligations.
3.7 Analytics and Improvement. We compile aggregated and anonymized usage statistics to understand how users interact with the Platform, identify areas for improvement, and measure the effectiveness of features and campaigns.
3.8 Legal and Compliance. We use information to comply with applicable laws, respond to legal process, enforce our Terms of Service, and protect the rights, property, and safety of RogIQ and others.
3.9 Legal Basis for Processing (GDPR). For users in the European Economic Area (EEA), UK, and Switzerland, we process Personal Information based on the following legal grounds:
- Contract: Processing necessary to perform our contract with you (providing the Platform);
- Legitimate Interests: Processing necessary for our legitimate business interests, including improving the Platform, fraud prevention, and security;
- Consent: Processing based on your consent, including marketing communications;
- Legal Obligation: Processing required to comply with applicable laws.
4. How RogIQ Protects Your Information
We implement and maintain reasonable administrative, technical, and organizational security measures designed to protect your Personal Information against unauthorized access, loss, destruction, alteration, or misuse. These measures include:
- Encryption of data in transit (TLS/HTTPS) and at rest (AES-256);
- Role-based access controls for our personnel;
- Regular security assessments and vulnerability testing;
- Incident response procedures.

5. When RogIQ Shares Your Information
We may share your Personal Information with the following categories of third parties:
5.1 Affiliates and Subsidiaries. We may share information with our corporate affiliates and subsidiaries for purposes consistent with this Privacy Policy.
5.2 Service Providers. We share information with vendors and service providers who help us operate the Platform, including cloud hosting providers, payment processors, customer support tools, analytics providers, email delivery services, and AI model providers. These service providers are contractually bound to protect your information and use it only as directed by us.
5.3 Partners. We may share information with marketing and integration partners where you have authorized such sharing, such as when you connect a third-party integration to your Platform Account.
5.4 Social Networks and Third-Party Services. If you connect social media or other third-party accounts to the Platform (such as Facebook, Google, LinkedIn, or other platforms), information may be shared with those platforms in accordance with their privacy policies.
5.5 Business Transfers. We may disclose or transfer Personal Information as part of a merger, acquisition, asset sale, financing, or other corporate transaction. We will provide notice of any such transfer where required by applicable law.
5.6 Legal and Regulatory. We may disclose your information: (a) as required by law or legal process; (b) to protect the rights, property, or safety of RogIQ, our users, or others; (c) to investigate potential violations of our Terms of Service; or (d) in response to valid requests from government authorities.
5.7 With Your Consent. We may share your information with third parties when you have given us your consent to do so.
5.8 No Sale of SMS Opt-In Data. We do not sell, rent, or share SMS opt-in data or phone numbers obtained through the Platform with third parties for their own marketing purposes.
6. Data Retention
We retain your Personal Information for as long as necessary to fulfill the purposes described in this Privacy Policy, including to provide you with the Platform, comply with legal obligations, resolve disputes, and enforce our agreements.
When determining appropriate retention periods, we consider the nature and sensitivity of the data, the purposes for which it is processed, applicable legal requirements, and potential risks.
When you close your Platform Account, we will delete or anonymize your Personal Information within a reasonable period, subject to our legal obligations to retain certain data. You may request deletion of your data at any time as described in Section 10.
7. Children's Privacy
The Platform is not directed to children under the age of 16, and we do not knowingly collect Personal Information from children under 16. If you believe we have inadvertently collected information from a child, please contact us at [email protected] and we will promptly delete it.
8. Links to Other Websites
The Platform may contain links to third-party websites or services. This Privacy Policy does not apply to those third-party sites. We encourage you to review the privacy policies of any third-party sites you visit.
9. Do Not Track
We do not currently respond to "Do Not Track" signals from browsers. You may control tracking through cookie settings as described in our Cookie Policy.
10. Your Privacy Rights
RogIQ respects your rights regarding your Personal Information. Depending on where you reside, you may have the following rights:
- Right to Access: Request a copy of the Personal Information we hold about you.
- Right to Correction: Request that we correct inaccurate or incomplete Personal Information.
- Right to Deletion: Request that we delete your Personal Information, subject to certain exceptions.
- Right to Portability: Request a machine-readable copy of certain Personal Information.
- Right to Object: Object to our processing of your Personal Information for direct marketing or based on legitimate interests.
- Right to Restrict Processing: Request that we restrict processing of your Personal Information under certain circumstances.
- Right to Withdraw Consent: Where processing is based on consent, withdraw your consent at any time.

11. European Privacy Rights (GDPR)
If you are located in the European Economic Area (EEA), the United Kingdom, or Switzerland, you have additional rights under the GDPR, UK GDPR, or Swiss nFADP:
11.1 Rights to Access, Portability, Correction, or Deletion. You may request access to, a copy of, correction of, or deletion of your Personal Information by contacting us at [email protected].
11.2 Right to Object. You can object to our processing of your Personal Information where we rely on legitimate interests as the legal basis, or object to processing for direct marketing purposes at any time.
11.3 Right to Restrict Processing. You may request that we restrict the processing of your Personal Information in certain circumstances, such as when you contest the accuracy of the data.
11.4 Right to Withdraw Consent. If we process your Personal Information based on your consent, you may withdraw that consent at any time. Withdrawal does not affect the lawfulness of processing prior to withdrawal.
11.5 Right to Lodge a Complaint. If you believe we are processing your Personal Information in violation of applicable data protection law, you have the right to lodge a complaint with the relevant supervisory authority in your country of residence.
11.6 International Transfers. Where we transfer Personal Information from the EEA, UK, or Switzerland to countries outside those regions, we ensure appropriate safeguards are in place, including Standard Contractual Clauses (SCCs) as adopted by the European Commission, or other legally approved transfer mechanisms.
12. U.S. Privacy Rights (CCPA/CPRA and State Laws)
Residents of California and certain other U.S. states have additional rights under applicable state privacy laws, including the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA).
12.1 Categories of Personal Information Collected. In the past 12 months, we have collected the following categories of Personal Information:
- Identifiers (name, email address, IP address, account ID);
- Commercial information (subscription details, purchase history);
- Internet or network activity (usage data, browsing history on the Platform);
- Geolocation data (IP-derived location);
- Inferences (usage patterns, preferences derived from Platform activity).
12.2 Right to Know. You have the right to request that we disclose the categories and specific pieces of Personal Information we have collected about you, the sources of that information, the purposes for which it is used, and the categories of third parties with whom it is shared.
12.3 Right to Delete. You have the right to request that we delete Personal Information we have collected from you, subject to certain exceptions.
12.4 Right to Correct. You have the right to request correction of inaccurate Personal Information.
12.5 Right to Opt Out of Sale/Sharing. RogIQ does not "sell" Personal Information for money. However, certain activities (such as sharing data with analytics and advertising partners) may be considered a "sale" or "sharing" under California law. You may opt out of such activity by using the "Your Privacy Choices" link on our website or contacting us at [email protected].
12.6 Right to Non-Discrimination. We will not discriminate against you for exercising your privacy rights.
12.7 Authorized Agent. You may designate an authorized agent to submit requests on your behalf. We may require verification of the agent's authority before processing the request.
13. International Data Transfers
RogIQ is headquartered in the United States. If you are accessing the Platform from outside the United States, your Personal Information may be transferred to and processed in the United States or other countries where our service providers operate. We take steps to ensure that such transfers are conducted in accordance with applicable law, including through the use of Standard Contractual Clauses or other approved mechanisms.
14. Privacy Policy Updates
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or for other business reasons. We will post the updated policy on the Platform with an updated "Last Updated" date. We will provide more prominent notice (such as an email notification) for material changes. Your continued use of the Platform after the effective date of any update constitutes your acceptance of the revised policy.

16. AI and Your Data
RogIQ's Platform includes AI features that process your data to provide personalized, intelligent functionality. Here is how we handle your data in the context of AI:
- AI Processing: AI features process content you provide and generate outputs based on that content. Your inputs are used to generate responses but are not permanently stored in AI models in a way that identifies you to other users.
- Model Improvement: We may use aggregated and anonymized data to improve our AI features and train our models. We do not use your personal data or your customers' personal data to train AI models in a way that could expose that data to other users.
- AI Provider Sub-processors: Our AI features rely on third-party AI providers (such as OpenAI and Anthropic) who process data as sub-processors subject to contractual data protection obligations. See our Sub-processor List for details.
